Do I need a licence to buy a pistol in New York?
Yes. Penal Law 400.00 requires a New York pistol licence before anyone may possess a handgun, and no dealer may transfer one to you without it. This is the single biggest difference between buying a pistol here and buying one in most other states.
Who issues a pistol licence in New York City?
The NYPD License Division. Outside the city it is the licensing officer for your county, usually a judge or a county official working with the State Police. A licence issued by New York City and one issued upstate are not interchangeable; the city licence is valid in the city, and moving in or out of the five boroughs means dealing with the new licensing officer.
What is the difference between a premises licence and a carry licence?
A premises licence lets you keep the pistol at the address on the licence and move it, unloaded and locked, to a range or a lawful hunting area. A carry licence allows you to carry it, within the conditions written on the licence and outside the state list of sensitive locations. Most first licences issued in the city are premises licences.
How long does it take?
Months. The statute expects a licensing officer to act within six months of a completed application, and in New York City the practical wait has often been longer once training, references, the investigation and the interview are counted. Start early and do not order a pistol until the licence is in hand.
What does it cost?
Expect several hundred dollars in application and fingerprint fees to the city, plus the cost of the required training course if you are applying to carry. The Division publishes its current fee schedule; check it before you apply, because the figures change.
What changed after the Bruen decision?
In 2022 the Supreme Court struck down New York’s requirement that a carry applicant show "proper cause" for a licence. The state responded the same year with a new package: an approved training course of sixteen classroom hours plus two hours of live fire, an in-person interview, character references, a list of sensitive locations where carry is prohibited, and a "good moral character" standard. Parts of that package have been challenged in court and the details have moved more than once, so work from the current NYPD and State Police guidance.
What is the "good moral character" standard?
The statute describes it as the essential character, temperament and judgement necessary to be entrusted with a weapon and to use it only in a manner that does not endanger yourself or others. In practice it gives the licensing officer room to weigh your history and your references, and it is why the interview and the references matter.
Do I need references?
Yes for a carry licence — the law requires character references, and the Division contacts them. They should be people who know you well and will answer the phone.
Does the pistol have to be listed on my licence?
In New York City, yes: the Division issues the purchase paperwork for a specific handgun and the licence is amended when you acquire it. Many counties outside the city work the same way. Your dealer will tell you exactly what they need to see before they will release the gun.
Can I order a pistol here while my application is pending?
Please don’t. We cannot ship a handgun to a New York dealer for a buyer without a licence, and the dealer will not transfer it. If you order one anyway and the transfer cannot be completed, the pistol comes back to us and we refund you — but you have waited for nothing.
Does a licence expire?
It has to be kept current. New York City licences are renewed on the Division’s cycle, and statewide licences must be recertified with the State Police every five years. Let one lapse and you can be left holding a handgun you are no longer licensed for, so diary the date.
